DiamondRank Terms of Service

1. Acceptance of Terms

Welcome to DiamondRank ("we," "our," or "us"). By accessing or using DiamondRank (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

DiamondRank is a youth baseball team rankings platform that allows team administrators to:
- Register their teams
- Upload game box scores and statistics
- View team rankings calculated using our proprietary algorithm
- Compare team performance across age groups and classifications

3. User Accounts and Eligibility

3.1 Account Registration

To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account

3.2 Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that you are of legal age to form a binding contract.

3.3 Team Administrator Responsibilities

If you register as a team administrator, you represent and warrant that:
- You are authorized to act on behalf of the team/organization you represent
- You have obtained all necessary consents from players, parents, and guardians
- You will comply with all applicable youth privacy laws (including COPPA)

3.4 Waitlist

DiamondRank is currently in a limited launch. If you join our waitlist, we collect your name, email address, and role (e.g., coach, league admin, parent) to notify you when registration opens and to send related updates. You can unsubscribe at any time.

4. User Content and Data Ownership

4.1 Your Content License to Us

By uploading game box scores, statistics, or other content to DiamondRank, you grant us a non-exclusive, worldwide, royalty-free license to:
- Store, process, and display your submitted data
- Calculate team rankings and statistics
- Display aggregated statistics and rankings publicly
- Use anonymized data for platform improvements and analytics

4.2 Box Score Upload Representations

IMPORTANT: By uploading game box scores (including PDFs generated by third-party platforms), you represent and warrant that:

a) You have the legal right to upload and share the game data contained in the box score
b) You own or control the underlying factual game information (scores, dates, team names, player statistics)
c) You have obtained all necessary consents from players, parents/guardians, and your organization to share this information
d) You are not violating any third-party terms of service or intellectual property rights
e) The data is accurate to the best of your knowledge

4.3 Third-Party Platform Content

DiamondRank is not affiliated with, endorsed by, or partnered with GameChanger, MaxPreps, or any other sports statistics platform.

When you upload box scores generated by third-party platforms:
- You acknowledge that you are extracting and sharing factual game data (scores, dates, statistics)
- You confirm you have the right to share this factual information
- You understand that DiamondRank does not claim ownership of third-party platform branding, logos, or proprietary formatting
- You accept full responsibility for ensuring your upload complies with any applicable third-party terms of service

4A. Third-Party Data Dependency — GameChanger

4A.1 Reliance on Third-Party Data

DiamondRank currently supports game data uploaded via box scores generated by GameChanger (a product of Dick's Sporting Goods, Inc.). DiamondRank is not affiliated with, endorsed by, sponsored by, or in any way officially connected with GameChanger or Dick's Sporting Goods, Inc.

4A.2 No Guarantee of Continued Compatibility

DiamondRank's ability to parse and process GameChanger-generated box scores depends on the format and availability of those documents. We make no guarantee that:
- GameChanger will continue to generate box scores in a format compatible with DiamondRank
- GameChanger will continue to make box scores available for download or export
- Changes to GameChanger's platform, PDF format, or data structure will not disrupt or break DiamondRank's data processing capabilities
- GameChanger will not restrict, limit, or prohibit the extraction or use of data from their box scores

4A.3 Service Interruption Due to Third-Party Changes

In the event that GameChanger or any other third-party platform changes its format, restricts data access, or otherwise prevents DiamondRank from processing uploaded data:
- DiamondRank will make reasonable efforts to update its systems to restore compatibility, but cannot guarantee a specific timeline or outcome
- DiamondRank is not liable for any interruption, degradation, or loss of service resulting from such third-party changes
- No refunds or credits will be issued solely due to service interruptions caused by third-party platform changes
- DiamondRank reserves the right to discontinue support for any third-party data format at any time

4A.4 Accuracy of Third-Party Data

DiamondRank processes game data as provided in uploaded box scores. We do not independently verify the accuracy of data generated by GameChanger or any other third-party platform. DiamondRank is not responsible for:
- Errors, omissions, or inaccuracies in GameChanger-generated box scores
- Incorrect scores, dates, team names, or statistics recorded by GameChanger
- Data entry errors made by coaches, scorekeepers, or administrators within GameChanger
- Any ranking errors or rating miscalculations that result from inaccurate third-party data

4A.5 User Responsibility for Data Accuracy

By uploading a box score, you represent and warrant that:
- The game data contained in the box score accurately reflects the actual game result to the best of your knowledge
- You have reviewed the uploaded data and believe it to be correct
- You will promptly dispute any game result you believe to be inaccurate using DiamondRank's dispute resolution process

4A.6 Trademarks

"GameChanger" and related marks are trademarks of their respective owners. Use of these names on DiamondRank is for descriptive purposes only and does not imply any affiliation or endorsement.

4B. Data Integrity and Prohibition on Fabricated Content

4B.1 Prohibition on AI-Generated or Fabricated Uploads

You are strictly prohibited from uploading any document, image, screenshot, or file that:

a) Was generated, altered, or fabricated using artificial intelligence tools, image editing software, or any other means to create a false or misleading representation of a game result
b) Does not accurately reflect an actual game that was played
c) Was modified from an authentic box score or screenshot in any way that changes the underlying game data (scores, dates, team names, innings, statistics)
d) Was created to simulate a legitimate box score or game screenshot without a corresponding real game having taken place

4B.2 Authentic Documentation Required

All uploads to DiamondRank — including PDF box scores, GameChanger screenshots, and any other game documentation — must be:

• Authentic: Exported or captured directly from the original scoring platform (e.g., GameChanger) that recorded the actual game
• Unaltered: Free from any edits, modifications, or enhancements to the underlying game data
• Accurate: Representing a game that was actually played between the listed teams on the listed date

4B.3 Consequences of Fabrication

Uploading fabricated, AI-generated, or altered game documentation is a serious violation of these Terms and constitutes fraud. DiamondRank may, at its sole discretion:

• Immediately suspend or permanently terminate your account and your team's registration
• Remove all games, rankings, and data associated with your account
• Report the violation to league administrators, tournament organizers, or other relevant parties
• Pursue legal remedies to the fullest extent permitted by law

4B.4 Reporting Suspected Fabrication

If you suspect another team has uploaded fabricated or altered game documentation, you may report it through DiamondRank's dispute resolution process or by contacting us directly at support@diamondrank.co. We take all such reports seriously and will investigate promptly.

4C. League and Tournament Data Admins

4C.1 Who This Applies To

Some users register as League/Tournament Data Admins rather than team administrators — typically league operators or tournament directors who upload game results on behalf of multiple teams they organize (for example, via bulk CSV import), rather than uploading only their own team's games.

4C.2 Representations by Data Admins

By registering as a data admin and uploading game data, you represent and warrant that:
- You are authorized to publish results for the league or tournament you represent
- The game data you upload (scores, dates, team names) is factual information you have the right to share
- You will promptly correct or remove data you learn to be inaccurate

4C.3 Team Rights Unaffected

Data admin uploads do not override an individual team's control over its own account. Teams may dispute games uploaded by a data admin through the standard dispute resolution process.

4.4 Data You Control

As a team administrator, you control:
- Which games you upload to DiamondRank
- Whether your team's detailed statistics are publicly visible
- Your team's contact and registration information

5. Game Verification and Accuracy

5.1 Verification System

DiamondRank uses a tiered verification system where a game counts toward rankings once it reaches one of the following:
- Fully verified: Both teams upload and confirm matching box scores
- Auto-verified: Only one team uploads a box score; after a waiting period, the game is verified using that score alone and counts at reduced weight in the ranking calculation
- League/tournament verified: A League/Tournament Data Admin uploads the result on behalf of the teams involved (see Section 4C)

Unverified games are displayed separately and do not affect official rankings. Teams can dispute game results through our dispute resolution process.

5.2 Accuracy Responsibility

You are responsible for the accuracy of all game data you upload. DiamondRank:
- Does not independently verify game scores or statistics
- Is not liable for ranking errors caused by inaccurate uploads
- May remove or flag games that appear fraudulent or inaccurate

6. Rankings Algorithm and Methodology

6.1 Ranking Calculation

DiamondRank calculates team ratings using a proprietary algorithm based on:
- Each game's result relative to the opponent's rating at the time of play, with run differential capped at ±12 runs per game
- Strength of schedule (the quality of opponents faced)
- Both fully verified games (confirmed by both teams) and auto-verified games (confirmed by only one team, which count at reduced weight)

6.2 No Guarantees

We make no guarantees regarding:
- The accuracy or predictive value of rankings
- College recruitment, scholarship opportunities, or tournament selection
- Any specific ranking position or rating

Rankings are provided for informational and entertainment purposes only.

7. Prohibited Activities

You agree NOT to:
- Upload false, misleading, or fraudulent game data
- Upload AI-generated, artificially created, edited, or fabricated box scores, screenshots, or game documentation
- Manipulate rankings through fake games or collusion
- Scrape, copy, or republish DiamondRank data for commercial purposes without permission
- Use automated tools to access or interact with the Service
- Harass, threaten, or abuse other users
- Upload content that violates third-party intellectual property rights
- Violate any applicable laws or regulations
- Impersonate another person or team

8. Privacy and Minors

8.1 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.2 Protection of Minors (COPPA Compliance)

DiamondRank does not knowingly collect personal information from children under 13 without verifiable parental consent.

As a team administrator uploading information about players:
- You must obtain verifiable parental consent before uploading data about players under 13
- You must provide proof of consent upon request
- Parents/guardians may request removal of their child's data at any time

8.3 Data Removal Requests

Players, parents, or guardians may request removal of player data by contacting us. We will remove such data within 30 days of verification.

9. Subscription Fees and Payments

9.1 Free and Paid Tiers

DiamondRank offers:
- Fan Tier: Free. Browse rankings and follow teams.
- Team Tier: Paid. Team registration, game uploads, and coaching tools.
- Tournament Pass / Tournament Pro: Paid tiers for tournament directors (coming soon).
- League/Tournament Data Admin: Free. For league and tournament organizers who bulk-upload game results on behalf of the teams they run (see Section 4C).

9.2 Payment Terms

If you subscribe to a paid tier:
- Fees are billed per season (see current pricing on our Pricing page)
- All fees are non-refundable except as required by law
- You authorize us to charge your payment method for recurring subscriptions
- We may change fees with 30 days' notice
- You can cancel at any time; cancellation takes effect at the end of the current billing period

9.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us.

10. Intellectual Property

10.1 DiamondRank Ownership

DiamondRank owns all rights to:
- The DiamondRank platform, website, and software
- The DiamondRank name, logo, and branding
- The ranking algorithm and methodology
- Aggregated, anonymized statistics and insights

10.2 Limited License to You

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for lawful purposes in accordance with these Terms.

10.3 Feedback

If you provide feedback or suggestions about the Service, we may use such feedback without obligation to you.

11. Disclaimers and Limitation of Liability

11.1 Service "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Accuracy, reliability, or completeness of rankings or statistics
- Uninterrupted or error-free operation
- Security of data transmission

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIAMONDRANK SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from inaccurate rankings or statistics
- Damages arising from user-uploaded content
- Damages exceeding the amount you paid us in the past 12 months

11.3 Basis of the Bargain

You acknowledge that we have set our prices and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein.

12. Indemnification

You agree to indemnify and hold harmless DiamondRank and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:
- Your violation of these Terms
- Your violation of any third-party rights (including intellectual property rights)
- Your uploaded content or data
- Your use of the Service

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us or using account settings.

13.2 Termination by Us

We may suspend or terminate your access to the Service:
- For violation of these Terms
- For fraudulent or abusive behavior
- For non-payment of fees
- At any time, for any reason, with or without notice

13.3 Effect of Termination

Upon termination:
- Your right to access the Service immediately ceases
- We may delete your account and data (subject to legal retention requirements)
- Sections that by their nature should survive will survive (including disclaimers, limitations of liability, and indemnification)

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing any legal claim, you agree to contact us to attempt informal resolution of any dispute.

14.3 Arbitration Agreement

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except:
- Small claims court actions (under $10,000)
- Injunctive relief for intellectual property violations

Arbitration Terms:
- Conducted by a single arbitrator under JAMS Streamlined Arbitration Rules
- Held in Buffalo, New York or your location (for claims under $10,000)
- Each party pays their own attorney's fees unless awarded by arbitrator
- DiamondRank pays all arbitration filing fees

14.4 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY, NOT AS A CLASS ACTION OR REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14.5 Opt-Out Right

You may opt out of arbitration by sending written notice to us within 30 days of accepting these Terms. Send to support@diamondrank.co with the subject line "Arbitration Opt-Out."

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and DiamondRank regarding the Service.

15.2 Amendments

We may update these Terms at any time by posting revised Terms. Continued use of the Service after changes constitutes acceptance.

15.3 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.4 No Waiver

Our failure to enforce any right or provision does not constitute a waiver.

15.5 Assignment

You may not assign these Terms. We may assign these Terms without restriction.
